USCIS Increasing Filing Fees for TN Mail-in Petitions

Starting April 1, 2024, the government filing fees required to file an I-129 petition for TN visa status by mail will significantly increase (along with the filing fees for many other cases).

Employers can file an I-129 petition by mail to obtain TN visa status on behalf of their employees in the following scenarios:

  • For initial TN status on behalf of Canadian citizens physically outside of the U.S.

  • For an extension of TN visa status on behalf of Canadian or Mexican citizens currently present in the U.S. under valid TN visa status.

  • For a change of employer on behalf of Canadian or Mexican citizens currently present in the U.S. under valid visa status.

  • To request a change of status (COS) to TN visa status on behalf of Canadian or Mexican citizens currently present in the U.S. under a different valid visa status.

The current government filing fees for these various I-129 TN petition filings, and the new filing fees for these petitions that go in effect April 1, 2024, are provided below.


TN I-129 FILING FEES CURRENTLY:

Required:

  • I-129 filing fee = $460

Optional:

  • I-907 premium processing fee (for petition review in 15 business days) = $2,805


TN I-129 FILING FEES STARTING APRIL 1, 2024:

Required:

  • I-129 filing fee =

    • $1,015; or

    • $510 (if employer is a non-profit; or has 25 or less FT employees)

Plus:

  • Asylum Program filing fee (new) =

    • $600; or

    • $300 (if employer has 25 or less FT employees); or

    • $0 (if employer is a non-profit)

Optional:

  • I-907 premium processing fee (for petition review in 15 business days) = $2,805
