USCIS Extends Validity Period Of Certain Employment Authorization Documents

USCIS has announced that it will be increasing the validity periods of certain Employment Authorization Documents (EAD) to 5 years. The categories of EADs that will be valid to 5 years include:

  • Individuals applying for Adjustment of Status (AOS) under INA s. 245 (this would include most AOS green card filings based on marriage to a U.S. citizen, or AOS filings based on employment).

  • Individuals admitted to the U.S. as refugees, those granted asylum, and those granted withholding of deportation/removal.

USCIS’ new policy will apply to I-765 applications for EADs that are pending or filed on or after Sept. 27, 2023.
