Auto Suppliers Seek Settlement For TN Visa Lawsuit

Suppliers for Kia and Hyundai seek court approval of a $1.2 million settlement to resolve a lawsuit filed by TN visa workers involving allegations of labor trafficking and racketeering. This is one of several cases recently filed by TN visa workers alleging that recruiters and employers engaged in unlawful bait and switch schemes where they promised professional-level Engineer/Technician roles to qualified Mexican citizens, but then placed the workers in manual labor positions.

These alleged schemes have resulted in increased scrutiny over TN visa applications filed in Mexico where many applicants are now being challenged over whether they are truly filling professional-level roles that qualify under an applicable TN occupational category.
