Update on Form I-539 Filing Address for TD Dependents

The dependent spouse and children of a principal TN nonimmigrant should note the following instructions when filing Form I-539 to change their nonimmigrant status or extend their TD stay:

  • Dependents filing together with the principal TN applicant: The entire I-129 and I-539 petitions for the principal TN worker and the TD dependents should be filed with the Vermont Service Center.

  • Dependents filing separately from the principal TN worker: If the principal TN applicant’s Form I-129 is still pending, the Form I-539 package for the dependent(s) should be filed with the same Service Center where the principal TN applicant’s Form I-129 is pending. Include a copy of the I-797 receipt notice for the principal TN applicant’s Form I-129. If the principal’s Form I-129 has already been approved and the principal’s status has already been changed or extended, the Form I-539 package for the dependent(s) should be filed with the Vermont Service Center. Include a copy of the principal TN worker’s I-797 approval notice and the TN worker’s current, unexpired I-94 as evidence of TN status.
