TN Visa Professionals with Approved I-140s: Unexpected Visa Number Availability

The State Department’s just released September 2007 Visa Bulletin shows visa number availability in most of the Employment based categories. Due to the return of unused July visa numbers by consular posts abroad and the limited demand eligible for final processing at consular posts, the State Department has reestablished cut-off dates in a majority of the Employment-based preference categories.

TN visa professionals with priority dates earlier than the cut-off dates provided below may file for the last stage of the green card process (adjustment of status or immigrant visa processing) during the month of September 2007.

  • EB-1 category with priority dates before January 1, 2007 for all countries;

  • EB-2 cases for all countries, including Mexico and the Philippines, with priority dates before January 1, 2007, for China with priority dates before January 1, 2006, and for India with priority dates before April 1, 2004;

  • EB-3 category, all countries except China, India, and Mexico, which are unavailable, with priority dates before August 1, 2002.
