TN VISA APPROVAL – COMPUTER SYSTEMS ANALYST (PRODUCT MANAGER JOB / MBA & ENGINEERING DEGREE)

BACKGROUND:    

  • The applicant, a citizen of Canada, had been offered a job as a Product Manager, which would involve planning, designing, and testing of systems for the company’s cloud software platform.

  • I reviewed the position offered, and although the job title was not entirely indicative of such a Computer Systems Analyst role, based on the position’s job duties I believed the position could be classified under the Computer Systems Analyst TN category.

  • Additionally, while the applicant did not possess a degree in Computer Science, I believed that he still could qualify under the Computer Systems Analyst TN visa category.


TN CATEGORY:    

  • Computer Systems Analyst


JOB TITLE / DUTIES:    

  • As the Product Manager job title was not indicative of a Computer Systems Analyst role, in my cover letter to USCIS I described how Computer Systems Analysts work in these types of roles, and I included extensive career and industry publications to support this claim.

  • I also highlighted that Computer Systems Analysts went by different job titles including Product Manager and similar variations.


EDUCATION:    

  • The applicant possessed an MBA degree and a degree in Mechatronic Engineering.

  • As with any case where the applicant does not possess a degree directly in the TN occupational category, it was imperative to establish how the applicant qualified under the Computer Systems Analyst TN visa category.

  • To establish eligibility, in my cover letter to USCIS I highlighted the applicant's Computer-related coursework completed during his degree programs and included his transcripts in the application.

  • I then supplemented the application with research establishing that a degree in Computer Science was not required for a Computer Systems Analyst position, and that individuals with degrees in a related field such as Business and Engineering could also qualify.


FILING PROCESS:    

  • TN visa status I-129 petition filed with the Vermont Service Center


PROCESSING TIME:    

  • Approved using premium processing in less than 2 weeks. No Request for Evidence (RFE) issued.


APPROVAL PERIOD:  

  • 3 years
