WHAT QUESTIONS ARE ASKED DURING AN INTERVIEW FOR A TD VISA?

Question: My spouse is working in the U.S. under TN visa status. I want to visit her there by getting a TD visa. What type of questions are asked in the interview to obtain a TD visa?

Reply: First, it is important to know what process is required for TD visa status.

  • If you are outside of the U.S., and a Canadian citizen, you can apply for your TD visa status at the border, which requires the presentation of documents and an interview with a USCBP border officer.

  • If you are outside of the U.S., and you are not a Canadian citizen, then you will first need to apply for a TD visa stamp at a U.S. consulate. This involves a DS-160 application filing, then the presentation of documents and an interview with a U.S. consulate officer. If you are issued a TD visa stamp, then when you seek entry at the U.S. border, you will need to present your documents and have an interview with a USCBP border officer.

Finally, the types of questions asked by U.S. consulate and/or USCBP border officers during an interview for a TD visa / status typically may involve:

  • Whether you are inadmissible to the U.S. (e.g. due to a prior immigration violation, criminal conduct, or under the new public charge ground of inadmissibility)

  • Your eligibility for TD visa status (e.g. where does your spouse work, is he/she still working and maintaining his/her TN visa status, etc.)

  • Your planned activities for the U.S. (e.g. will you engage in unauthorized employment)

  • Your anticipated length of stay in the U.S.
