TN VISA TO GREEN CARD APPROVED - MARRIAGE USC

Green CardCase Info.

Case History / Issues:

Applicant was a Canadian citizen, and held TN visa status. Applicant was married to a U.S. citizen.

Strategy:

Reviewed case for eligibility, and to ensure no preconceived intent issues, or potential employment gap or travel issues. The applicant's TN status had expired prior to filing the green card application. While not ideal, due to an exception in the law this failure to maintain status did not prevent eligibility for a green card based on marriage to a U.S. citizen. The filing of the adjustment application did not restore the applicant to lawful immigration status, but did stop the accrual of unlawful presence. The applicant was otherwise a good candidate for Adjustment of Status.
