TN Visa Approval-Graphic Designer (Product Design Manager job title; BBA Degree)

BACKGROUND:    

  • The applicant, a citizen of Mexico, had been offered a job as a Product Design Manager.

  • I reviewed the position offered, and although the job title did not exactly match the TN visa category, based on the position’s job duties and supporting research, I believed the position could be classified under the Graphic Designer TN category.

  • Additionally, while the applicant did not possess a degree in Graphic Design, I believed that he still could qualify under the Graphic Designer TN visa category.


TN CATEGORY:    

  • Graphic Designer


JOB TITLE / DUTIES:    

  • As the Product Design Manager job title was not indicative of a Graphic Designer role, in my cover letter to the U.S. Embassy I described how Graphic Designers work in these types of roles, and I included extensive career and industry publications to support this claim.

  • I also highlighted that Graphic Designers went by different job titles including those similar to the position offered.


EDUCATION:    

  • The applicant possessed a Bachelor of Business Administration degree in Design & Management. 

  • As with any case where the applicant does not possess a degree directly in the TN occupational category, it was imperative to establish how the applicant qualified under the specific TN visa category.

  • To establish eligibility, in my cover letter to the Embassy I highlighted the applicant's Graphic Design-related coursework completed during his degree program and included his transcripts in the application.

  • I then supplemented the application with research establishing that a degree in Graphic Design was not required for a Graphic Designer position, and that individuals with degrees in a related field could also qualify.


FILING PROCESS:    

  • TN visa status application applied at the U.S. Embassy in Mexico.


PROCESSING TIME:    

  • Approved and TN visa issued in approx. 1 week. 


APPROVAL PERIOD:  

  •  TN visa stamp issued valid for 1 year; I-94 issued valid for 3 years.
