Appeals Office Approves H-1B Petition for Sole-Proprietor

The Administrative Appeals Office (“AAO”) found that the Petitioner, a limited liability corporation formed by the beneficiary, as a separate legal entity may proceed with an H-1B petition filed on behalf of the owner as a Graphic Designer. Although the beneficiary would be engaged in some administrative tasks as a sole proprietor, the AAO found that most of the duties of the position included those of a graphic designer and, as result, the position offered qualified for an H-1B visa.
